These Terms of Use (“Terms”) apply to your use of modernagilesystems.com (the “Site”), including the chat and the client portal, operated by Modern Agile Systems Consultants (“we”, “us” or “our”). By using the Site you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
Using the Site
You may use the Site to learn about our services, contact us and, if you are a client, use the portal. You agree not to:
- Try to gain unauthorized access to the Site, its servers, the portal or other people’s accounts, or test or scan them for vulnerabilities without our written permission.
- Interfere with the Site’s security protections or disrupt its operation.
- Send malware, spam or anything unlawful, harmful or misleading, including through the chat.
- Copy or extract content or contact details from the Site by automated means, other than search engines indexing public pages.
- Impersonate anyone or misrepresent your relationship with a business.
We may block access to the Site, automatically or manually, to protect it and its users.
Information on the Site and in the chat
Content on the Site and answers from the chat’s artificial intelligence assistant are general information about our company and services, not advice for your specific situation. Case studies describe results for particular clients; every project is different and they are not a promise of similar results. We try to keep everything accurate and current but do not guarantee it is complete or error-free.
Our services
Our services are provided under a separate written proposal, statement of work or service agreement. That agreement, not these Terms, sets the scope, price, schedule and other conditions. If these Terms conflict with a signed agreement, the agreement controls. Nothing on the Site is an offer until agreed in writing.
Client portal
- Portal accounts are for authorized people at our clients. We create them and may suspend or close them, for example when someone leaves your business or an account is misused.
- Keep your username and password private and tell us right away if you think your account was used without permission. You are responsible for activity under your account.
- Give accurate information in your requests and do not include passwords or card numbers unless we ask for them through a secure method.
- Response times are those in your service agreement. The portal is not an emergency line: for urgent issues, call us as well.
Careers
Job postings on the Site describe positions we may fill. They are not an offer of employment or a contract, and we may change or withdraw them at any time.
Intellectual property
The Site, including its text, design, graphics, code, the Modern Agile Systems Consultants name and the “M” logo, belongs to us or our licensors and is protected by copyright and trademark law. You may view and print pages for your own non-commercial use. Any other use requires our written permission. Client names, logos and images in our case studies belong to their owners and are shown to describe our work.
Feedback
If you send us ideas or suggestions about the Site or our services, we may use them without any obligation to you.
Links to other websites
The Site links to websites we do not control. We are not responsible for their content or practices, and a link does not mean we endorse everything on them.
Disclaimer
The Site is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, and we do not promise that the Site will be uninterrupted or free of errors.
Limitation of liability
To the fullest extent the law allows, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or business, related to your use of or inability to use the Site. This does not limit liability under a signed service agreement, which has its own terms, or any liability that cannot be limited by law.
Indemnity
You agree to defend and hold us harmless from claims, losses and costs (including reasonable attorneys’ fees) arising from your misuse of the Site or violation of these Terms.
Governing law
These Terms are governed by the laws of the State of Florida. Any dispute relating to the Site will be brought in the state or federal courts located in Hillsborough County, Florida, and you consent to their jurisdiction.
Changes to these Terms
We may update these Terms from time to time. The date at the top shows when they last changed. Continuing to use the Site after a change means you accept the updated Terms.
